Liability Waiver, Media Release and Privacy Notice Statement

Definitions

  • “Federation” or “FCSS-FESC” refers to the Federation of Canadian Secondary Students / Fédération des élèves du secondaire au Canada, an entity incorporated under the Canada Not-for-profit Corporations Act and a registered charity within the meaning of the Income Tax Act

  • “Event” refers to the Young Policy Leaders Conference taking place at MPL Angus Glen's Program Room, on 26 May 2024, as amended as the case may be.

  • “Attendee” refers to an individual or corporation in attendance at the Event. This includes event organizers, judges, volunteers, and participants.

Liability Waiver

This Liability Waiver, executed voluntarily, hereby releases the Federation and its directors, officers, employees, volunteers, agents, contractors, and representatives (collectively “Releasees”). 

The Attendee desires to attend an event hosted by the Federation or the business of the Federation, and engages in activities pertinent to the event.

The Attendee affirms that they understand that the scope of their relationship with the Federation is limited to an event attendee capacity and that no compensation is expected in return for any services provided by the Attendee. 

The Attendee understands that Federation will not provide any benefits or privileges traditionally associated with employment to the Attendee and that the Attendee is responsible for any costs or liabilities associated with any injury or illness sustained as a result of their participation in event activities or other business of the Federation.

The Attendee releases and forever discharges and holds harmless the Federation, and their successors and assigns from any and all liability, claims, and demands of whatever kind of nature, either in law or in equity, which arise or may hereafter arise from the Attendee’s participation in business of the Federation or event activities, including transportation to and from the activity.

The Attendee understands and acknowledges that this Release discharges the Federation from any liability or claim that they may have against the Federation with respect to bodily injury, personal injury, illness, death, or personal property damage that may result from the Attendee’s participation in business of the Federation or event activities.

The Attendee understands that the Federation does not assume any responsibility for or obligation to provide the Attendee with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. 

The Attendee expressly waives any such claim for compensation or liability on the part of the Federation beyond what may be offered freely by the Federation in the event of injury or medical expenses incurred.

The Attendee hereby releases and forever discharges the Federation from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my tenure as a Attendee of the Federation or attendee at an event hosted by the Federation.

The Attendee understands that the services they provide to the Federation or activities they participate in during the course of business or during events may be hazardous to the Attendee. 

As an attendee participating in business of the Federation or activities during events hosted by the Federation, the Attendee hereby expressly assumes risk of injury or harm from these activities and releases the Federation from all liability. 

The Attendee understands that they are entitled to withdraw from activities which they deem unsafe for their personal well-being and those which may infringe their personal rights or beliefs.

The Attendee understands that they are responsible for arranging their own transportation to and from the venue.

The Federation acknowledges that the COVID-19 pandemic continues to circulate in communities where the Event is or may be held. The Federation recommends that the Attendee follow leading public health advice, including:

  • wearing a mask or non-fabric protective face covering for the duration of the Event;

  • completing a full series of COVID-19 vaccinations, including any recommended booster doses;

  • washing hands frequently with warm soap and water, and using an alcohol-based hand sanitizer when necessary;

  • maintaining a safe distance from other attendees at the Event; and

  • any other signage, placards, or announcements that may be made during the Event by the Federation.

The Attendee understands that even despite following the public health guidance included above, the risk of acquiring a new COVID-19 infection by participating in the Event is possible. The public health advice above serves only to reduce the risk of exposure, but does not eliminate it. By attending the event, the Attendee assumes all risks, regardless of the number and degree of public health recommendations they opt to comply with. The Attendee will hold harmless the Federation for any contagious illnesses contracted in the course of participating in the Event in accordance with the general release from injury and harm above.

Media Consent Release

Note: Media Consent Releases permit the dissemination of specific personally identifiable information of Attendees for public relations and promotional purposes.

The Attendee grants their consent to the collection and use of their personal images by photography or video recording, including audio (“the Media”).

The Attendee acknowledges that the Media may be used on the Federation’s website, in newsletters, and publications as well as distributions to other Attendees. 

The Attendee understands that the Media may be circulated widely and that, if posted on the Federation’s website and other websites, they will be available to the public. The Attendee further understands that the Federation has no control over, and is not responsible for, the use or misuse of materials on its website, including the Media. 

For the purposes stated above, the Attendee consents to be photographed and/ or to be video and/or audio recorded by the Federation or its authorized representatives.

The Attendee forever releases the Releasees from any and all actions, claims, or demands that the Attendee, their assignees, heirs, distributees, guardians, next of kin, spouse, and legal representatives now have, or may have in the future, for injury, death, or property damage, related to: (i) their participation in these activities, (ii) the negligence or other acts, whether directly connected to these activities or not, and however caused, by any Releasee, or (iii) the condition of the premises where these activities occur, whether or not the Attendee was then participating in the activities.

Privacy Notice Statement

The Attendee acknowledges that their personal information will be collected and used in accordance with the guidelines below. 

Personal information collected includes, but is not limited to: 

  • full name; 

  • mailing address; 

  • school board and school name; 

  • contact information, including email and phone number; 

  • contact information for parent or guardians, including email and phone number; 

  • dietary restrictions; 

  • birthday; and 

  • student numbers. 

Personal information will be used to, but is not limited to: 

  • predict event attendance and purchase relevant materials and supplies; 

  • facilitate registration; 

  • conduct analysis of the organization's reach; 

  • ensure the safety of attendees;

  • communicate food orders to caterers;

  • generate certificates of accomplishment;

  • validate volunteer hour information;

  • share future opportunities; and 

  • inform the development of future events. 

Personal information collected by FCSS-FESC will be deleted within 365 calendar days. Access to personal information is only available to event organizers who require it for the conduct of their duties.

The Attendee acknowledges that they are aware, understand and agree to the privacy policies of the aforementioned tools. Information processed through these tools is subject to the retention of individual companies and may not be within the control of the FCSS-FESC.
